Which buildings are in the 2027 BEPP cohort?

Based on City program information, the 2027 BEPP compliance cycle applies to non-residential buildings with a gross floor area between 100,000 and 200,000 sq ft. Buildings above 200,000 sq ft appear to fall within the BEPP program as well, with their own compliance obligations.

Key 2027 deadlines

Alternative Compliance Plans open

First day building owners may submit an Alternative Compliance Plan for the 2027 cohort.

High Performance reports due

Deadline for High Performance pathway reports. Also the first day to submit exemption or extension requests.

Tune-Up Report deadline

Deadline for Building Tune-Up Reports for the 2027 cohort. Buildings that have not complied via another pathway by this date face potential penalties.

Penalty structure

Based on City program information, buildings that do not comply with BEPP requirements by the applicable deadline may face the following penalties:

$2,000 initial fine

An initial fine of $2,000 may apply for non-compliance following the applicable deadline.

$500 per day after 30 days

After the first 30 days following the applicable deadline, an additional $500 per day may accrue until the building comes into compliance.
